1. The Services

Colorist.ai is an AI-powered interactive video romance platform providing real-time interactive video stories, AI character interactions, choice-driven plots, original character (OC) awakening, and immersive visual storytelling.

Depending on your access tier and feature availability, the Services may include real-time video scene generation, custom character creation, interactive story progression, and visual/text generation tools.

We may modify, update, suspend, limit, expand, discontinue, or remove any part of the Services at any time for operational, technical, legal, compliance, security, or other reasonable reasons. Where a change materially affects your core use of the Services, we will make reasonable efforts to provide notice.

2. Account Registration and Use

You may need to create an account to use certain features of the Services. You agree to provide accurate, current, and complete registration information, and to keep that information updated.

When you create an account, you must confirm that you are at least 18 years old and that you agree to these Terms and our Privacy Policy. We may decline, suspend, or terminate registrations that do not include this confirmation.

You are responsible for maintaining the confidentiality of your account credentials, including your password, verification codes, and any other login information. You are responsible for all activities that occur under your account unless caused directly by our failure to use reasonable security measures.

You may not:

• Impersonate another person or entity;
• Register or use an account with false or misleading information, including false age information;
• Sell, rent, transfer, share, or otherwise make your account available to an unauthorized third party;
• Use scripts, bots, automation, bulk registration methods, or abusive technical means to obtain accounts or access the Services.

3. Age Requirements

You must be at least 18 years old to create an account or use Colorist.ai.

By creating an account or using Colorist.ai, you confirm that you are at least 18 years old. If the laws in your jurisdiction require a higher minimum age to use the Services, you must meet that higher age requirement.

Colorist.ai is not intended for anyone under 18. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from someone under 18, we will take reasonable steps to delete it.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial, and lawful entertainment use.

Except as expressly permitted by law or by us in writing, you may not:

• Copy, reproduce, distribute, sell, lease, sublicense, or commercially exploit any part of the Services;
• Reverse engineer, decompile, disassemble, decode, or attempt to derive source code, underlying AI models, parameters, algorithms, or internal logic from the Services;
• Bypass, disable, interfere with, or circumvent access controls, safety systems, moderation rules, rate limits, security features, Diamond deduction mechanisms, or billing systems;
• Use crawlers, scraping tools, bots, automated systems, or abnormal traffic methods to access the Services; or
• Interfere with or disrupt the integrity, performance, or normal operation of the Services or related servers.

6. User Content and Acceptable Use

You are solely responsible for any text, prompts, images, audio, video, links, files, instructions, characters, custom OCs, or other content that you submit, upload, generate, transmit, share, or make available through the Services ("User Content").

You represent and warrant that your User Content and your use of the Services will not:

• Violate any applicable law or regulation;
• Infringe, misappropriate, or otherwise violate the intellectual property, privacy, publicity, data protection, or other legal rights of any person or entity, including using a real person's name, likeness, image, or voice without authorization;
• Include fraudulent, deceptive, defamatory, harassing, abusive, threatening, hateful, discriminatory, or otherwise harmful content;
• Contain malware, viruses, malicious code, or other harmful digital components; or
• Facilitate, encourage, instruct, or promote illegal, fraudulent, or dangerous activity.

We reserve the right, but have no obligation, to review, monitor, remove, restrict, or disable access to any User Content or account where we believe there is a violation of these Terms, applicable law, or safety rules.

7. Zero Tolerance for Obscene and Harmful Content

Colorist.ai does not permit, host, or generate illegal, abusive, sexually explicit, or inappropriate content.

You may not use the Services to create, request, upload, submit, generate, transmit, or share content that includes or relates to:

• Explicit pornography, obscenity, or non-consensual sexual acts;
• Sexual content or sexualization involving minors, suspected minors, or age-ambiguous real or fictional characters;
• Sexual violence, coercion, non-consensual behavior, bestiality, incest, or unlawful abuse; or
• Evasion of these restrictions through coded language, roleplay framing, fictional setups, indirect prompts, or technical bypasses.

If we detect such conduct, we reserve the right to immediately remove the content and take action including warnings, feature restrictions, immediate account suspension or termination, forfeiture of unused Diamonds, and reporting to legal authorities where appropriate, without liability to you.

8. AI Characters and AI-Generated Content

All companions, characters, and responses on Colorist.ai are generated by artificial intelligence systems and are not real human beings.

When you interact with a character, you are engaging with an AI model, and all video responses, visual micro-expressions, text responses, and audio are AI-generated outputs. All personalities, backstories, settings, and relationships are entirely fictional and designed solely for interactive video romance and storytelling.

AI-generated outputs may occasionally be inaccurate, incomplete, or visually unnatural. AI-generated content is provided for creative, conversational, and entertainment purposes only. The Services do not constitute human relationships and are not a substitute for professional mental health, medical, legal, or emotional therapy support.

You are responsible for evaluating any output before relying on it. You must not rely on the Services for critical decisions, including medical, legal, mental health, or financial matters.

9. Intellectual Property

The Services, including software, AI video generation engines, models, visual interfaces, card designs, UI copy, artwork, logos, graphics, audio, video snippets, and code, are owned by us or our licensors and are protected by applicable intellectual property laws.

As between you and us, you retain any intellectual property rights you hold in your original User Content. However, by submitting or generating content through the Services, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, process, modify, transmit, display, and perform your User Content strictly to the extent necessary to operate, maintain, secure, improve, moderate, and provide the Services to you and other users.

If you submit feedback, suggestions, or ideas regarding Colorist.ai, you agree that we may use them without restriction or obligation to compensate you.

10. Privacy and Data

Your privacy is important to us. Our collection, use, storage, sharing, and protection of personal information are described in our Privacy Policy, which is incorporated into these Terms by reference.

We implement reasonable security measures to protect the Services and your data; however, no internet transmission or electronic storage system is 100% secure.

We may process technical logs, device information, usage data, error reports, content signals, age-confirmation records, and transaction logs as necessary to operate the Services, prevent abuse, deduct Diamonds accurately, maintain security, troubleshoot performance, and comply with legal requirements.

11. Third-Party Services

The Services may integrate with or rely on third-party websites, payment processors, authentication providers, or cloud infrastructures. These third-party services operate independently and are governed by their own terms and privacy policies.

We are not responsible for the availability, security, practices, or content of third-party payment systems or platforms. Where a payment issue arises, we will make reasonable efforts to assist you within our operational capacity.

12. Suspension and Termination

We may suspend, restrict, or terminate your account or access to all or part of the Services at any time, with or without prior notice, if:

• You violate these Terms or applicable legal regulations;
• You fail to meet the age requirement stated in Section 3;
• Your conduct poses a legal, security, operational, or reputational threat to Colorist.ai, other users, or third parties;
• Account information provided is fraudulent, false, or suspicious; or
• Required for routine technical maintenance, abuse prevention, or compliance obligations.

You may stop using the Services at any time and may request account deletion via account settings or by contacting us. Upon account termination due to a violation of these Terms, any remaining unused Diamond balance will be forfeited without refund, unless applicable law mandates otherwise.

13. Disclaimers

To the maximum extent permitted by applicable law, the Services are provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, uptime, or output accuracy.

We do not warrant that:

• The Services or AI video generation will be uninterrupted, timely, secure, or completely error-free;
• The video quality, text output, or response times will meet your specific technical expectations on all devices; or
• Deficiencies or AI generation glitches will always be corrected immediately.

14. Changes to These Terms

We reserve the right to modify these Terms from time to time to reflect product updates, legal changes, or operational requirements. Updated Terms will be published on our site with a revised "Last Updated" date.

If a change materially alters your legal rights or obligations, we will make reasonable efforts to provide notice. Your continued use of the Services after the effective date of revised Terms constitutes your acceptance of those changes.

16. Miscellaneous

Our failure to enforce any right or provision shall not constitute a waiver of such right.
